Our Guarantees

The legality of selling used software licenses in the European Union (EU) is based on the principle of exhaustion of rights. According to the ruling of the Court of Justice of the EU in the UsedSoft case, when a software license is sold in the EU with the permission of the copyright owner, the copyright owner's exclusive right to distribute the software is considered exhausted. This means that the original purchaser has the right to resell the used software license, and the subsequent purchaser acquires the same rights to use the software as if he had purchased it directly from the copyright owner.

There is set of requrements which has to be fulfill to make whole proces of transfering licence owerschip legal. We follow them strictly, it includes, but is not limited to:

RULE 1


PERPETUAL

The Microsoft licenses must be perpetual.

RULE 2


PAID IN FULL

The Microsoft licenses must be paid in full.

RULE 3


REDUNDANT

The Microsoft licenses must be redundant.

RULE 4


FIRST USE

The first use of the Microsoft licenses must be within the EU.

Our Guarantees

Each License Owner Transfer Form (Licence Transfer Form or LOF for short), a document that is (along with a paid invoice) a formal confirmation of the transfer of license ownership, is issued by LicensePro BV, which:

  • has almost 10 years of experience in trading pre-owned licence;
  • guarantees that the licenses purchased are in compliance with applicable laws, regulations and will pass a licensing audit;
  • this guarantee also includes an obligation to fully indemnify the buyer against the costs of any legal defense (for example, court and attorney fees);
  • In order to guarantee 100% fulfillment of the above obligations, LicencePro BV has an appropriate insurance policy covering such obligations.
