The legality of selling used software licenses in the European Union (EU) is based on the principle of exhaustion of rights. According to the ruling of the Court of Justice of the EU in the UsedSoft case, when a software license is sold in the EU with the permission of the copyright owner, the copyright owner's exclusive right to distribute the software is considered exhausted. This means that the original purchaser has the right to resell the used software license, and the subsequent purchaser acquires the same rights to use the software as if he had purchased it directly from the copyright owner.
